Welcome to the www.colivys.com website, an online platform for booking furnished and equipped accommodation for subletting, and for purchasing booking formulas and options ancillary to subletting.
We invite you to read carefully these general terms and conditions of use and general terms and conditions of sale (hereinafter referred to as the “GCU/CGV”) as well as our privacy policy in order to be able to browse and, where applicable, book and purchase our services and products on our website.
The User, whether an individual, a customer or not, is hereby informed that he/she is bound by these terms and conditions.
The use of the services of the present site, as well as any browsing, registration as a Member and reservation or purchase implies the prior, full and entire acceptance of the present GCU/CGV and our privacy policy, which the User acknowledges having read and agrees to respect.
Definitions :
User: any person browsing the site;
Member: any person who registers as such in his or her Member space;
Customer: any person who books or purchases a service, product, offer or service from Colivys. The Customer has a Member account;
Username: the e-mail address required to identify a User on the Site in order to access his/her account;
Password: the succession of characters which the User must keep secret and which, together with the User ID, enables him/her to access his/her account;

Booking formula: the services provided by Colivys to the Customer. There are 3 different booking formulas detailed below, the content and price of which differ according to the time of booking and the place booked. Payment of the reservation package validates the Customer’s reservation request;
Reservation: the choice of accommodation and payment of a reservation package;
Check-in: the moment when Colivys hands over the keys of the accommodation to the Customer, which generally coincides with the inventory of fixtures on arrival, unless Colivys is unavailable at the time of the Customer’s arrival (very early or very late, for example);
Check out: the moment when the Customer hands over the keys of the accommodation to Colivys, which generally coincides with the check out, unless Colivys is unavailable at the time of the Customer’s departure (very early or very late, for example).
Obligations and rights of the User
The User is responsible for his/her computer equipment and Internet access. The site is accessible free of charge to any User with Internet access. All costs relating to access to the site shall be borne by the User;
The User is responsible for compliance with any laws, rules and regulations, and tax obligations that may govern the use of the Site or Colivys Services;
The User acknowledges that he/she is prohibited from using any means or process to hijack, harm or damage the content displayed by Colivys on its site (e.g. viruses, cancelbots, Trojan horses, malicious code, IP address spoofing, etc.) or from using the site to send spam or advertisements;
The User is also prohibited from infringing the rights of Colivys or any other Colivys User or any other person by any means whatsoever;
The User may only access his or her account after identification using his or her Username and Password; The User is required to keep his or her Username and Password secret and must not disclose them to any third party;
The User undertakes to make personal and non-commercial use of the site;
The User shall be liable for any loss or damage that may be incurred by Colivys, including without limitation legal fees, arising from any breach of these terms and conditions, warranties or other terms or from your misuse of material or information obtained through the Site;

Colivys’ rights and obligations
Colivys makes every effort to ensure the proper functioning of its site and 24/7 access to the site but cannot be held responsible for the presence of a virus on its site or for any problem or malfunction preventing the User from accessing the site or the products and services offered;
Colivys will do its utmost to resolve any problem as quickly as possible;
Colivys makes every effort to publish accurate and up-to-date information;
However, Colivys reserves the right to modify, delete or add content, options or functions on its site, or to deactivate access at any time and without notice. All content is published without warranty (to the extent permitted by applicable law);
Use of the Site and/or its content by the User is at the User’s own risk and Colivys shall not be liable to compensate the User for any direct or indirect loss resulting therefrom;

Colivys owns all intellectual property rights attached to the Site and its content. The User may not copy, reproduce, publish, upload, post, transmit, extract, reuse, store or distribute all or any part of the Site or its contents in any form without the prior permission of Colivys;
Colivys reserves the right to investigate and prosecute any breach of the above conditions to the fullest extent permitted by law, and to take any action, including removing or preventing access to all or part of the Site or the Content, in the event of any breach of this section or these Conditions;
Colivys may access, retain and disclose information transmitted by the User if it is legally required to do so or if it believes in good faith that it is reasonably necessary to do so;
Creation of a Member account by the User
The User may create an account to become a Member and then a Customer on the site if he/she wishes to access and benefit from Colivys services/offers;
By creating an account, the User accepts Colivys’ Terms and Conditions and Privacy Policy;
The creation of an account on the Site is reserved for any natural person aged at least 18 years or holder of a parental authorization and having the legal capacity to contract enabling him to place an order on the present site;
The same applies if the User is acting on behalf of a legal entity, in which case he or she declares that he or she has the legal capacity to represent it;
Each User may create only one Member account on the Colivys site;
All fields in the account creation form must be completed, with the exception of those indicated as optional;
Failure to do so will result in the account not being created. All information provided by the User must be accurate;
The Member may enter any telephone number: office and/or mobile and/or home;
The User, Member and Customer undertake to provide true, accurate and complete information about the site and Colivys in general;
Personal data provided by Registered Members and Customers will be treated with the appropriate level of accuracy and security, in accordance with our Privacy Policy. When the User creates an account on the Site, he/she will receive an account creation confirmation e-mail the same day;
Colivys reserves the right to delete any account that does not comply with these contractual conditions;
The User will only be able to access his account after identification using his Username and Password; The User is required to keep his Username and Password secret and must not communicate them to a third party;
The User undertakes not to create additional accounts for the purpose of abusing the site or impersonating another registered Member;
The User is responsible for the activities of his/her Member/Customer account;
If the Member suspects that he/she has been “hacked”, he/she must contact Colivys so that Colivys can block or close the account;
The User undertakes not to attempt to cause damage to Colivys or to other Users and/or Members and/or Customers, and not to hack the site in any way whatsoever;
Colivys reserves the right to close a Member’s account at any time and without prior justification, if the Member causes harm to Colivys and/or other Users and/or Members and/or Customers. This right will be exercised at Colivys’ discretion;
Colivys’ advertisements may be consulted by any User. However, only registered Members may reserve accommodation and subscribe to services and options and thus become Customers.
II – MEDIATION
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, our company has set up a consumer mediation system. The chosen mediation body is: SAS CNPM – MÉDIATION – CONSOMMATION. In the event of a dispute, the consumer may file a claim on the website: http://cnpm-mediation-consommation.eu or by post by writing to CNPM – MÉDIATION – CONSOMMATION 27, avenue de la Libération – 42400 SAINT-CHAMOND.
Content protection
All content present or made available through the www.Colivys.com website, such as text, drawings, graphics, images, music, photos, trademarks and logos, digital downloads, etc., is the property of Colivys, its affiliates or third parties. This content is protected by intellectual property rights.
Termination of account
You may terminate this agreement at any time by deleting your account via the site and destroying all content and other materials obtained from the site. Colivys may terminate this agreement at any time, in its sole discretion, if it considers that there has been a breach of any term or condition, or if Colivys is required to do so by law, or if the continuation of the agreement is likely to be no longer commercially viable.
Entire agreement
If any part, term or provision of this Agreement is determined by a court of competent jurisdiction to be illegal, unenforceable or contrary to applicable law, the remaining parts or provisions shall remain in full force and effect.
