If one of the roommates leaves, what does the lease attest of? The lease contract lists all the rules, obligations, and rights associated with the two parties, the lessor and the lessee(s). The type of lease will be different if the accommodation is rented empty or furnished. The lease must be written in as many copies as there are parties (an original and copies).<\/span><\/p><p><span style=\"font-weight: 400;\">As with any rental agreement, its content and application are governed by law. Some leases may be subject to the ALUR law, as is the case with<\/span> <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F34661\" target=\"_blank\" rel=\"noopener\">French legislation for shared rentals<\/a>. <b>This is not the case at Colivys<\/b><span style=\"font-weight: 400;\">, but here are some of the requirements that you may be asked to respect when signing a shared lease:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Roommates do not have to be married or in a civil union. You can opt for an <\/span><b>individual lease<\/b><span style=\"font-weight: 400;\"> assigned to each roommate, a<\/span><b> unique lease for all roommates <\/b><span style=\"font-weight: 400;\">or a <\/span><b>lease that places one of the roommates as main tenants<\/b><span style=\"font-weight: 400;\">. The other tenants are then considered subtenants.<\/span><\/p><p><span style=\"text-decoration: underline;\"><strong>A lease for each of the co-tenants<\/strong><\/span><\/p><p><span style=\"font-weight: 400;\">The individual lease is similar to a traditional lease, between the lessor and the tenant. <\/span><b>This is what we have chosen at Colivys<\/b><span style=\"font-weight: 400;\">. The tacit conditions explained above (i.e. the absence of family ties between the lessor and the tenant) must be respected.<\/span><\/p><p><span style=\"text-decoration: underline;\"><strong>A single lease for all the co-tenants<\/strong><\/span><\/p><p><span style=\"font-weight: 400;\">This type of contract allows the landlord to place all the roommates on a single contract. All the tenants are obliged to sign this lease, otherwise their legal status in the eyes of the shared housing could change. Indeed, his\/her status could go from co-tenant to simple occupant. His\/Her rights as a roommate could then be cancelled.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">It is also possible that the landlord includes a solidarity clause. In the case of unpaid rent or the departure of one of the roommates, the remaining roommates agree to pay the full rent.<\/span><\/p><p><span style=\"text-decoration: underline;\"><strong>A lease for the main tenant and the sub-tenants<\/strong><\/span><\/p><p><span style=\"font-weight: 400;\">With the landlord&#8217;s agreement, it is possible for the tenant to sublet the apartment. In this case, the co-tenants are not subject to the solidarity clauses mentioned above.
